Pasal 27
BAB 4 — ### TRANSFORMASI
(1) Permohonan transformasi terhadap Pendaftaran Internasional yang telah diberikan pelindungan di
Indonesia dan telah memenuhi ketentuan Pasal 26 ayat (3) dan ayat (4), dicatat dan diumumkan dalam Berita Resmi Merek oleh Menteri.
(2) Pelindungan hukum terhadap pendaftaran Merek melalui permohonan transformasi sebagaimana
dimaksud pada ayat (1) diberikan sejak Tanggal Pendaftaran Internasional.
(3) Terhadap pendaftaran Merek yang diajukan dengan permohonan transformasi sebagaimana
dimaksud pada ayat (1), Tanggal Pendaftaran Internasional menjadi Tanggal Penerimaan berdasarkan Undang-Undang.

(4) Permohonan transformasi terhadap Pendaftaran Internasional yang belum diberikan pelindungan di
Indonesia dan telah memenuhi ketentuan Pasal 26 ayat (3) dan ayat (4), Menteri tetap melanjutkan proses permohonan tersebut dari tahap terakhir sebelum Pendaftaran Internasional dibatalkan.
(5) Proses permohonan sebagaimana dimaksud pada ayat (4) dilakukan berdasarkan ketentuan Undang-
Undang.
(6) Dalam hal Pendaftaran Internasional yang dibatalkan tidak dilakukan transformasi, Menteri mencatat
dan mengumumkan pembatalan dalam Berita Resmi Merek.
Article 28
(1) Marks that are already registered based on provisions of the Law can undergo an alteration to become
Marks that are registered based on International Registration and are addressed to Indonesia.
(2) The alteration as referred to in paragraph (1) can only be undertaken under the following conditions:
the Mark has already been registered prior to an International Registration being addressed to Indonesia;
the owner of the registered Mark is the same with the Holder of International Registration;
the registered Mark has an overall similarity to the International Registration; and
the type of goods and/or services within the registered Mark are found within the International Registration.
(3) The application for alteration as referred to in paragraph (1) shall be submitted in writing by the Holder
to the Minister while being charged with a fee.
(4) The Minister shall notify the occurrence of an alteration to the International Bureau.
CHAPTER VI
Article 29
This Regulation of the Government comes into force from the date of its promulgation.
For the purpose of public cognizance, it is hereby ordered that this Regulation of the Government be promulgated in the State Gazette of the Republic of Indonesia.
