MASA BERLAKU
- Persetujuan ini akan mulai berlaku pada tanggal Kedua Pihak menginformasikan,
melalui saluran diplomatik, bahwa Para Pihak telah mematuhi formalitas yang
disyaratkan oleh ketentuan hukum nasional agar Persetujuan ini mulai berlaku,
akan valid untuk periode sepuluh tahun, dan secara otomatis diperpanjang untuk
periode waktu yang sama.
- Persetujuan ini dapat diubah dengan kesepakatan bersama dan perubahan yang
disepakati akan mulai ber1aku sesuai dengan ketentuan ayat 1 pasal ini.
- Salah Satu Pihak dapat menghentikan Persetujuan ini dengan pemberitahuan tertulis
kepada Pihak Lainnya melalui saluran diplomatik. Penghentian tersebut akan mulai
bertaku enam bulan setelah pemberitahuan diterima.
- Kecuali disepakati lain, penghentian tersebut tidak akan memengaruhi
kesepakatan setiap aktivitas kerja sama yang secara formal dihasilkan selama
masa berlaku Persetujuan ini, di mana pelaksanaan aktivitas tersebut akan
dilakukan hingga selesai.
SEBAGAI BUKTI, yang bertanda tangan di bawah ini telah menandatangani
Persetujuan ini.
DIBUAT di San Jose pada dua puluh dua Agustus dua ribu lima belas dalam Bahasa
Indonesia, lnggris, dan Spanyol, semua naskah memiliki keabsahan yang sama. Dalam hal terjadi perbedaan penafsiran, naskah Bahasa lnggris yang harus berlaku.

EI Gobierno de la Rep~blica de Indonesia y el Gobierno de la Rep~blica de
Costa Rica, en adelante referidos como "las Partes":
RECONOCIENDO el deseo de fortalecer los lazos de amistad existentes entre
las Partes;
COMPROMETIDOS en fortalecer m~s las relaciones y el desarrollo de ~reas
de entendimiento mutuo que puedan resultar en cooperaci6n entre las Partes;
CONSCIENTES del deseo de promover la transferencia de tecnologia, el
intercambio de informaci6n y la investigaci~n cientifica y de aprovechar su
potencial para el desarrollo;
RECONOCIENDO las ventajas reciprocas que resultarn de la cooperaci6n
t~cnica sostenida en areas de inter~s com~n;
POR MEDIC del presente acuerdan lo siguiente:
ARTiCULO 1
OBJETIVOS GENERALES
1 . El objetivo fundamental del presente Acuerdo, en adelante referido como
"el Acuerdo", es la promoci6n de la cooperaci6n tecnica, econ6mica,
cientifica y cultural entre las Partes, a trav~s del desarrollo y ejecuci6n de
programas y proyectos especificos en areas de inter~s com~n.
- Las Partes prestarn facilidades a entidades del sector publico y privado,
cuando se requiera, para el desarrollo y la ejecuci6n de programas y
proyectos de cooperaci6n.
- Asimismo otorgaran importancia a la ejecuci6n de proyectos conjuntos de
desarrollo tecnol6gico que vinculen centros de investigaci6n de ambos
paises.
- Con base en el presente Acuerdo, las Partes podran celebrar acuerdos
complementarios de cooperacibn, en reas especificas de inter~s com(n.
ARTiCULO 2
~REAS DE COOPERACI~N
Las Partes desarrollar~n, de comun acuerdo, proyectos de cooperacion de
conformidad con las leyes, reglamentos, politicas, planes y programas de sus
respectivos Gobiernos y tomando en cuenta sus posibilidades cientificas,
t~cnicas y financieras, en las areas que consideren de mayor importancia, en
particular, en las areas de educaci6n, cultura, salud, turismo, agricultura,
ambiente, ciencia y tecnologia, biblioteca y archivos, deportes y juventud,
cooperativas, fortalecimiento institucional del Servicio Exterior, los derechos de
los nifos y la familia en todas sus manifestaciones, y en cualquier otra area
que pueda ser acordada mutuamente por las Partes.
ARTiCULO 3
MODALIDADES DE LA COOPERACIN
1 . Los proyectos mencionados en el articulo anterior, podran asumir las
siguientes modalidades:
realizaci6n conjunta de programas de investigaci6n y desarrollo;
envio de expertos, investigadores, profesionales y t~cnicos;
transferencia de experiencias y capacidades institucionales (Mejores
Pr~cticas Institucionales);
- programas de pasantias para entrenamiento profesional,
particularmente en areas prioritarias para ambas Partes;
organizaci6n de seminaries y conferencias;
desarrollo de servicios de consultoria;
talleres de capacitaci6n profesional;
organizaci6n de ferias, exposiciones y eventos de diverso tipo, en
forma individual o conjunta;
proyectos conjuntos de desarrollo tecnol6gico;
intercambio de informaci~n t~cnica y cientifica;
intercambio de mejores practicas en conservaci6n y ecoturismo; y I. cualquier otra modalidad acordada por las Partes.
- En el intercambio de informaci6n cientifica y t~cnica obtenida como
resultado de los proyectos de la cooperaci6n bilateral, se observaran las
leyes vigentes en ambos Estados. Las partes coordinar~n a trav~s de los
canales diplomaticos, cuando sea necesario proteger el inter~s de uno de
los Estados Parte.
- La propiedad intelectual resultante de proyectos que se desarrollen en
forma conjunta por las Partes estar~ sujeta a copropiedad. La regulaci6n
para cada caso ser~ acordada en el respectivo instrumento especifico.
ARTiCULO 4
MECANISMO BILATERAL DE CONSULTA SOBRE COOPERACI~N
Las Partes estableceran un Mecanismo Bilateral de Consulta sobre Cooperaci6n que se reunir ordinariamente en sesiones acordadas por las
Partes, comenzando tan pronto come sea posible tras la entrada en ejecuci6n
de este Acuerdo y alternando entre Costa Rica e Indonesia. Las fechas sern
acordadas previamente por la via diplom~tica. Las Partes pueden reunirse
extraordinariamente cuando las circunstancias lo requieran.
ARTiCULO 5
INTEGRACI~N DEL MECANISMO BILATERAL
DE CONSULTA SOBRE COOPERACI~N
1 . EI Mecanismo Bilateral de Consulta sobre Cooperaci6n estara
conformado por las respectivas delegaciones nacionales integradas por el
personal tecnico relevante, presididas por el Viceministro de Relaciones
Exteriores o el respective alto funcionario del Ministerio de Relaciones
Exteriores de Indonesia y el Viceministro de Relaciones Exteriores o por
el Director de Cooperaci6n Internacional del Ministerio de Relaciones
Exteriores y Culto de Costa Rica.
- Ambas partes consideraran la conveniencia de permitir la participaci6n del
sector privado en sus reuniones.
ARTiCULO 6
EL PROGRAMA BIENAL DE COOPERACIN BILATERAL
1 . Con el prop6sito de ejecutar este Acuerdo, por medic de sus consultas
bilaterales, las Partes estableceran un "Programa Bienal de Cooperaci~n
Bilateral" que sera estructurado con base en las proyectos elaborados par
las organismos y entidades nacionales de cada uno de los paises, de conformidad con sus areas de inter~s. Se presentar~ al Ministerio de
Relaciones Exteriores de Indonesia y a la Direcci6n de Cooperaci6n
Internacional del Ministerio de Relaciones Exteriores y Culto de Costa
Rica para su facilitaci6n y desarrollo.
- Los proyectos o actividades cumpliran con todas las especificaciones,
incluyendo: objetivos, cronogramas de trabajo, costos previstos, recursos
financieros, recursos t~cnicos, a~reas de ejecucin, asi como las
obligaciones operativas y financieras de cada una de las Partes.
- Los 6rganos competentes de cada una de las Partes evaluaran
anualmente cada uno de los proyectos que conformen el Programa y
presentaran a sus respectivos Gobiernos las recomendaciones
necesarias para su mejor ejecuci6n.
ARTiCULO 7
MODALIDADES DE FINANCIAMIENTO
1 . La ejecuci6n de los Programas que se adopten en el marco del presente
Acuerdo se realizar~ bajo la modalidad de costos compartidos, salvo que •« otra modalidad sea acordada por las Partes.
- Para la implementaci6n de los programas especificos que se adopten, las
Partes podr~n solicitar, de com~n acuerdo y cuando sea posible, fuentes
de financiamiento alternativas para la ejecuci6n de sus programas conjuntos, incluyendo modalidades de cooperaci6n triangular.
ARTiCULO 8
EJECUCI~N DEL ACUERDO Y SOLUCI~N DE DISPUTAS
1 . El presente Acuerdo se ejecutar~ bajo la coordinaci6n del Ministerio de
Relaciones Exteriores de Indonesia y de la Direcci6n de Cooperaci6n
Internacional del Ministerio de Relaciones Exteriores y Culto de Costa
Rica.
- Para la ejecuci6n de este Acuerdo, asi como para la de los acuerdos
complementarios que emanen de ~l, las Partes se podran beneficiar de la
participaci6n de instancias regionales, multilaterales o de terceros paises,
en caso de que ambas Partes asi lo consideren necesario y oportuno.
- Cualquier disputa derivada de la interpretaci6n o aplicaci6n del presente
instrumento, ser~ solucionada de com~n acuerdo por las Partes.
ARTiCULO 9
ENTRADA EN VIGENCIA
1 . El presente Acuerdo entrara en vigencia a partir de la fecha en que ambas
Partes se hayan comunicado, a trav~s de la via diplomtica, el
cumplimiento de las formalidades exigidas por su legislaci~n nacional
para la entrada en vigor del presente Acuerdo y tendr~ un plaza de
vigencia de diez anos, prorrogable automaticamente por periodos iguales.
- Este Acuerdo puede ser modificado por mutuo consentimiento y las
modificaciones acordadas entrarn en vigor de conformidad con el
numeral uno del presente articulo.
- Cualquiera de las Partes podra, en todo momenta, denunciar el presente
Acuerdo, mediante notificaci6n escrita dirigida a la otra, por la via
diplom~tica. Dicha denuncia surtir~ efecto seis meses despu~s de su
notificaci6n.
- A menos que se haya acordado de otra forma, la terminaci6n del presente
Acuerdo no afectar~ la conclusion de las actividades de cooperaci~n
formalizadas durante su vigencia, las que seguiran ejecut~ndose hasta su
total culminaci6n.
EN FE DELO CUAL, los abajo firmantes suscriben el presente Acuerdo.
Hecho en la ciudad de San Jose, Costa Rica, a los veintid6s dias del mes de
agosto de dos mil quince, en idioma espafiol, ingl~s e indonesio, siendo todos
los textos igualmente v~lidos. En caso de divergencia en la interpretacibn,
prevalecer~ el texto en ingl~s.

FRAMEWORK COOPERATION AGREEMENT
BETWEEN
THE REPUBLIC OF INDONESIA
AND
THE REPUBLIC OF COSTA RICA
The Government of the Republic of Indonesia and the Government of the Republic
of Costa Rica, hereinafter referred to as "the Parties":
RECOGNIZING the wish to strengthen the existing ties of friendship between the
Parties;
COMMITTED to further strengthen relations and develop areas of mutual
understanding that will result in cooperation between the Parties;
CONSCIOUS of the desire to promote technology transfer, information
exchange, and scientific research and harness their potential for development;
RECOGNIZING the reciprocal advantages that will result from sustained
technical cooperation in common areas of interest;
HEREBY agree as follows:
ARTICLE 1
GENERAL OBJECTIVES
1 . This Framework Cooperation Agreement hereinafter referred to as "the
Agreement", aims to promote technical, economic, scientific and cultural
cooperation between the Parties, through the development and
implementation of specific programs and projects in areas of common
interest.
- The Parties will provide collaboration to entities from the public and private
sector, as needed to develop and implement cooperation programs and
projects.
- At the same time, the Parties will place importance on the implementation
of joint technological development projects that will link research
institutions within both countries.
- Based on the present Agreement, the Parties will be able to enter into
complementary cooperation agreements in specific areas of common
interest.
ARTICLE 2
AREAS OF COOPERATION
The Parties will jointly develop cooperation projects in accordance with the laws,
regulations, policies, plans and programs of their respective governments and
taking into account their scientific, technical, and financial capabilities, in those
areas that are considered of great importance, particularly in the areas of education, culture, health, tourism, agriculture, environment, science and
technology, library and archives, sports and youth, cooperatives, institutional
strengthening of the foreign service, the rights of children and families in all their
forms, and in any other area that may be mutually agreed upon by the Parties.
ARTICLE 3
MODALITIES OF THE COOPERATION
- The projects mentioned in the previous article, can assume the following
modalities:
- joint development of research and/or development programs;
- provision of experts, research analysts, professionals and technicians:
- exchange of experiences and institutional capacities (Institutional
Best Practices);
- exchange of professional training, particularly in priority areas for both
Parties;
conducting seminars and conferences;
development of consultancy services;
professional training workshops;
organizing fairs, expositions and other events either individually or jointly;
joint projects for technological development;
exchange of technical and scientific information;
exchange of best practices in conservation and ecotourism; and I. any other modality agreed to by the Parties.
- Local laws in each State will govern the exchange of technical and scientific
infonnation obtained as a result of the bilateral cooperation projects hereunder.
The Parties will coordinate through diplomatic channels when necessary to
protect the interest of the State.
- The intellectual property arising from projects that are developed jointly by the Parties will be jointly owned. The regulation for each case will be agreed in the
respective specific instrument.
ARTICLE 4
MECHANISMS FOR BILATERAL CONSULTATION ON COOPERATION
The Parties will establish a Mechanism for Bilateral Consultation on Cooperation that
will meet in ordinary sessions as agreed by the Parties, beginning as soon as possible upon the execution of this Agreement alternately in Costa Rica and Indonesia.
Meeting dates shall be set via diplomatic channels. The Parties can meet in extraordinary sessions when the circumstances so require it.
ARTICLES
COMPOSITION OF THE MECHANISM
FOR BILATERAL CONSULTATION ONCOOPERATION
- The Mechanism for Bilateral Consultation on Cooperation will be comprised of
national delegations of relevant technical personnel, presided by the Deputy
Minister of Foreign Affairs or respective Senior Official of the Ministry of Foreign
Affairs of Indonesia and Deputy Minister of Foreign Affairs or Director of
International Cooperation of the Ministry of Foreign Affairs and Worship of the
Costa Rica.
- Both Parties will consider the relevance of allowing the participation of the
private sector in the meetings.
ARTICLE 6
THE BIENNIAL BILATERAL COOPERATION PROGRAMME
- For the purpose of implementing this Agreement, the Parties, through their
bilateral consultations, will establish a "Biennial Bilateral Cooperation Program"
which will be structured on the basis of the projects developed by the national
entities from each of the countries, in accordance with their area of interest. It
will be presented to the Ministry of Foreign Affairs of Indonesia and the Directorate of International Cooperation within the Ministry of Foreign Affairs and Worship of Costa Rica for further facilitation and development.
- The projects or activities shall lay out all the specifications, including: objectives,
timeline, identified costs, financial resources, technical resources, areas of
implementation, as well as the operational and financial obligations of each of the Parties.
- The competent organs of each of the Parties will evaluate on a yearly basis each of
the projects that make up the Program and will present to their respective Governments the necessary recommendations for the best method of implementation.
ARTICLE7
FINANCIAL MODALITIES
- The implementation of the Programs that are adopted under the present Agreement will be undertaken through the shared cost modality, unless the Parties
agree to another modality.
- For the Implementation of the specific programs that are adopted, the Parties may
mutually agree where feasible, alternative sources of funding for the execution of
the joint programs or projects, including the use of triangular cooperation.
ARTICLE 8
IMPLEMENTATION OF THE AGREEMENT AND DISPUTE SETTLEMENT
- This Agreement will be implemented under the coordination of the Ministry of
Foreign Affairs of Indonesia and the Directorate of International Cooperation
from the Ministry of Foreign Affairs and Worship of Costa Rica.
- For the implementation of this Agreement as well as of the complementary agreements emanating from it, the Parties will be able to benefit from the
participation of regional, multilateral or third country partners, when both Parties deem it necessary or expedient to do so.
- Any dispute in regards to the interpretation or application of this Agreement, will
be resolved by common agreement of the Parties.
ARTICLE 9
ENTRY INTO FORCE
- The present Agreement will enter into force on the date that both Parties infonn,
through diplomatic channels, that they have complied with the formalities required
by their internal legislations for this Agreement to enter into force and will be valid
for a period of ten years, automatically renewed for equal periods.
- This Agreement can be mcx:Jified by mutual consent and the agreed modifications
will enter into force according to paragraph 1 of this article.
- Either Party can denounce this Agreement, through written notice to the other, via
diplomatic channels. The denouncement will take effect six months after service of
notice.
- Unless otherwise agreed, the denouncement will not affect the conclusion of any
cooperation activities formally presented during the validity of the Agreement, which will be executed until their total culmination.
IN WITNESS WHEREOF, the undersigned have signed this Agreement.
Done in the City of San Jose on the twenty-second day of August, two thousand and
fifteen in the Indonesian, English, and Spanish Languages, all texts being equally
authentic. In case of any divergence in the interpretation, the English text shall prevail.
